Serve Studio – Algemene Voorwaarden (NL)

1. Definities



1.1 Serve Studio / wij / ons / onze: Serve Studio, gevestigd aan Vijverhofstraat 64, 3032 SN Rotterdam, Nederland, ingeschreven bij de Kamer van Koophandel onder nummer 84827068.

1.2 Klant / Gebruiker / u: iedere particulier (consument) die de website bezoekt of een boeking plaatst.

1.3 Diensten: alle cosmetische salon-behandelingen, cursus-, workshop- en studio-services die door Serve Studio of haar submerken worden aangeboden.

1.4 Deposit / Aanbetaling: een niet-restitueerbare reserveringsvergoeding, betaald om exclusieve agendatijd en behandel-/stoel-capaciteit te blokkeren en vrij te houden.





2. Toepasselijkheid & Aanvaarding



2.1 Deze voorwaarden zijn van toepassing op alle boekingen en overeenkomsten tussen Serve Studio en de Klant.

2.2 Door te boeken via Salonized en actief akkoord te vinken op de voorwaarden, aanvaardt de Klant deze voorwaarden expliciet en rechtsgeldig, inclusief het Deposit-beding.





3. Websitegebruik



3.1 De website dient rechtmatig gebruikt te worden.

3.2 Serve Studio is niet aansprakelijk voor externe technische storingen buiten onze macht.





4. Diensten, Boekingen & Deposit



4.1 Alle diensten worden uitsluitend op afspraak uitgevoerd en vereisen een bevestigde boeking.

4.2 Voor het bevestigen van een afspraak-spot kan een Deposit vereist zijn.

4.3 De Klant erkent en aanvaardt dat:


  • Het Deposit geen betaling is voor reeds verrichte arbeid of een gegarandeerd behandel-resultaat, maar een vergoeding voor de exclusieve reservering van tijd, capaciteit en opportunity-cost;
  • Deposits onder geen enkele omstandigheid restitueerbaar zijn, ongeacht:
    • de annuleringsreden,
    • welke partij annuleert (Serve Studio óf de Klant),
    • of het besluit van de Klant om niet te herplannen.



4.4 Bij annulering door Serve Studio onder Overmacht:


  • worden alle indirecte kosten of schadeclaims kwijtgescholden (zoals reiskosten of opgenomen vrije dagen),
  • maar blijft het Deposit-beding volledig van kracht, omdat dit een reserveringsvergoeding is, geen schadevergoeding.



4.5 De Klant erkent dat gevolgkosten zoals reiskosten, vrij-genomen dagen of planning-inspanningen nooit een juridische grond vormen voor terugbetaling, chargebacks of het vervallen van de deposit-clausule.





5. Annuleren & Verplaatsen door Klant



5.1 Annuleren of verplaatsen kan tot 48 uur vóór de afspraak.

5.2 Max. 3 keer kosteloos verzetten, mits buiten 48 uur.

5.3 Binnen 48 uur / No-show → volledige bedrag verschuldigd, deposit wordt verrekend.

5.4 >10 minuten te laat kan leiden tot vervallen afspraak als no-show.





6. Leeftijd & Toestemming



6.1 Minimumleeftijd voor tooth gems, grillz en whitening is 16 jaar, of <16 met schriftelijke ouder/voogd-toestemming.

6.2 Locked Jewels kan zonder ouderlijke toestemming.

6.3 Onjuiste leeftijdsinfo = uitsluiting aansprakelijkheid aan onze zijde.





7. Betalingen



7.1 Restbetaling wordt voldaan op de afspraakdag, tenzij anders overeengekomen.

7.2 Alle prijzen inclusief Nederlandse BTW, tenzij anders vermeld.

7.3 Deposits zijn nooit restitueerbaar.





8. Herroepingsrecht (alleen fysieke producten, online gekocht)



8.1 EU-consumenten hebben een 14-dagen herroepingsrecht op fysieke product-aankopen, mits ongebruikt en verzegeld retour.

8.2 Uitzonderingen: maatwerk of hygiëne-opengebroken producten.

8.3 Dit recht geldt nooit voor salon-Deposits of behandelingen, omdat dit geen product-aankoop maar capaciteit-reservering is.





9. Klachtenbeleid & Herstel



9.1 Klachten melden binnen 48 uur (diensten) of 7 dagen (producten).

9.2 Wij mogen beoordelen en wanneer passend herstellen/vervangen, maar geen geldelijke refund op Deposits of niet-geleverde diensten, behalve waar wettelijk verplicht bij fysieke online product-koop.





10. Aansprakelijkheid



10.1 Serve Studio is niet aansprakelijk voor indirecte of gevolgschade, waaronder reiskosten, planning, omzet- of opvangverlies.

10.2 Maximale aansprakelijkheid = bedrag betaald voor de behandeling zelf, Deposits uitgesloten.





11. Intellectueel Eigendom



11.1 Alle content, merknamen, formats, technieken, opleidingen en designs blijven Serve Studio’s eigendom.





12. Privacy



12.1 Persoonsgegevens worden verwerkt via Privacyverklaring. Door te boeken stemt Klant hiermee in.





13. Vouchers, Cursussen & B2B



13.1 Vouchers zijn niet inwisselbaar voor contanten.

13.2 Cursussen & B2B kunnen aanvullende voorwaarden bevatten, maar tasten nooit het Deposit-beding aan.





14. Overmacht



14.1 Overmacht = omstandigheden buiten redelijke controle, inclusief medische overmacht aan onze zijde (acute migraine/ziekte/noodzaak).

14.2 Overmacht → geen schadevergoeding, maar deposit-clausule blijft volledig van kracht omdat dit een capaciteit-reserveringsvergoeding is.

14.3 De overeenkomst blijft geldig zolang Serve Studio een nieuw voorstelmoment voor uitvoering doet.





15. Geschillen



15.1 Nederlands recht is van toepassing.

15.2 Geschillen civiel → exclusief bevoegde rechter in Nederland.





16. Wijzigingen AV



16.1 Serve Studio mag de AV updaten. Laatste versie vervangt eerdere.





17. Externe In-House Diensten



17.1 Onafhankelijke artiesten/derde partijen (bijv. externe tattoo-artists) vallen buiten onze aansprakelijkheid.

17.2 Claims worden rechtstreeks met de derde afgehandeld.





18. Submerk-Specifieke Voorwaarden



18.1 De onderstaande voorwaarden gelden aanvullend en integraal bij boekingen onder onze submerken.

18.2 De Deposit-bepalingen uit Artikel 4 en 14 gelden onverminderd voor alle submerken.





B1. RoffaGems – Tooth Gems



B1.1 Behandeling


  1. Cosmetische bonding; non-invasive; geen verdoving.
  2. Plaatsing op onder-/tand-rand = eigen risico klant.
  3. Geen medische diagnose of doel.



B1.2 Contra-indicaties


  1. Zwanger/borstvoeding = niet aanbevolen.
  2. Actieve cariës, parodontitis, losse vulling, allergie resin/metaal/latex → eerst tandarts.
  3. Medicatie melden; wij mogen weigeren/uitstellen o.b.v. safety.



B1.3 Risico’s

Tijdelijke gevoeligheid/irritatie, whitening-schaduw, zeldzaam losraken/inslikken.


B1.4 Aftercare

24 uur geen zuur/hard voedsel; normal brushing; not picking; pain/loosening = contact directly.


B1.5 Garantie

1 maand enkel op de gem, niet op kronen/porselein/rand, geen result-garantie duur/esthetiek.





B2. RoffaGems – Teeth Whitening (Smile Atelier Whitening service)



  1. Cosmetisch bleken gel + LED; geen diagnose; results are variable.
  2. <16 / zwangerschap / actieve gebitsproblemen → niet uitvoeren.
  3. Aftercare 48 uur geen kleur-staining; brush mild fluoride.
  4. Deposit = capacity reservation fee → never refundable, always applicable.






B3. RoffaGrillz – Custom Grillz



  1. 100% handmade, decorative en remov-able; mini-imperfections = normal handwork characteristics.
  2. Akkoord bij fitting/oplevering = product geaccepteerd → latere aanpassingen/herstel = tegen kosten.
  3. Always remov-ed bij eten/slapen/sport; clean mild soap + soft brush; store dry/apart.
  4. Deposit = reserving treat-ment/capacity → never refundable.






B4. Locked Jewels – Permanent Jewelry



  1. Jewelry on custom length; permanent microweld-ed; spark visible; protective eyewear mandatory.
  2. Niet indestructible; pull/snags/impact = eigen risico klant.
  3. Aftercare 24 uur avoid chemicals/alcohol/perfume/lotions; patina/verkleur-ing = natural process.
  4. 14-dagen garantie enkel op de las, niet op color/pH/patina/pulling damage.
  5. Chain lost/damaged → geen re-weld mogelijk; nieuwe chain-fee applies.
  6. Deposit = capacity reservation fee → never refundable.






B5. Smile Atelier – Teeth Whitening



  1. Whitening is a cosmetic treatment; outcomes vary; no medical guarantee.
  2. Customers must disclose relevant medical conditions.
  3. Aftercare 48 hours avoid staining products.
  4. Deposit = non-refund-able reservation fee.






B6. RoffaGems, RoffaGrillz & Locked Jewels Photo/Editorial Services



  1. Content captured by Serve Studio can be used for marketing unless the customer explicitly declines in writing before the shoot.
  2. Serve Studio retains full IP rights on all created designs, photos, and educational formats.

Serve Studio – Terms & Conditions (EN)

1. Definitions



1.1 Serve Studio / we / us / our: Serve Studio, Rotterdam, The Netherlands, registered with KvK number 84827068.

1.2 Customer / Client / User / you: any private individual (consumer) booking or using our services.

1.3 Services: all cosmetic salon or in-house treatments, courses and studio services provided by Serve Studio or its sub-brands.

1.4 Deposit: a non-refund-able reservation fee paid to block exclusive appointment capacity and agenda/chair time, including opportunity cost.





2. Applicability & Acceptance



2.1 These Terms apply to all consumer bookings and agreements.

2.2 By scheduling an appointment through Salonized and actively checking the agreement box, the Customer explicitly and legally accepts these Terms in full, including the Deposit clause.





3. Website Use



3.1 You agree to use the website responsibly and lawfully.

3.2 Serve Studio is not liable for outages beyond our control.





4. Services, Bookings & Deposits



4.1 Serve Studio may require a Deposit to secure an appointment spot.

4.2 The Customer acknowledges that a deposit is not a payment for delivered labor or guaranteed treatment results but a non-refundable reservation fee to block exclusive appointment capacity and agenda/chair time.

4.3 Deposits are never refund-able, regardless of:


  • cancellation reason,
  • cancelling party (Serve Studio or Customer),
  • or the Customer’s decision not to reschedule or rebook.



4.4 In any Serve Studio cancellation under Force Majeure, including medical force majeure such as acute migraine, sudden illness or medical emergency:


  • Serve Studio waives all liability for future Customer damage claims or indirect costs,
  • but the Deposit condition remains fully enforceable as it refers only to reservation of capacity and opportunity cost, not delivered labor or treatment results,

4.5 Indirect Customer expenses such as travel costs or booked days off work never create a legal right to refunds, cancellation of the agreement, chargeback claims or dissolution affecting the Deposit clause itself.


4.6 Serve Studio will always offer a reasonable alternative moment to perform the service, unless permanently proven impossible by Serve Studio in writing.





5. Cancellations, Rescheduling, No-Shows



5.1 Rescheduling is allowed up to 3 times at no cost if requested more than 48 hours before the appointment.

5.2 Any change or no-show within 48 hours → the customer owes the full remaining balance, deposit offset included.

5.3 Arriving more than 10 minutes late may be considered no-show.





6. Age & Consent



6.1 Minimum age 16, or <16 with guardian consent.





7. Payment Terms



7.1 Remaining balance must be paid on appointment date.

7.2 Prices include Dutch VAT.

7.3 Deposits remain non-refundeerland and can’t be contested as a refund for labor.





8. Withdrawal Right (Only Physical Goods)



8.1 14-day return applies only to eligible physical product purchases in the EU, unused and sealed.

8.2 Not applicable to salon deposits, as these are capacity reservation fees, not product purchases.





9. Client Responsibility



9.1 Customers must disclose medical conditions, allergies and medication.

9.2 We may refuse/postpone tretaments for safety.





10. Intellectual property & Liability



10.1 Serve Studio retains all IP rights and excludes deposit payments from liability refunds.





11. Privacy



11.1 Handled according to Privacy policy consent.





12. Amendments



12.1 Most recent posted version supersedes earlier.





13. Third-Party In-House Providers



13.1 Independent providers operate at own liability.





14. Sub-Brands



14.1 The following Terms apply add-itionally.

14.2 The Deposit clause (Article 4) applies to all sub-brands equally.



14.3 

RoffaGems – Tooth Gems



  • Cosmetic dental bonding; non-invasive, no anaesthesia.
  • Lower/edge placement = Customer’s risk.
  • Outcomes vary individually.
  • 1-month warranty on the gem only if at-home Aftercare followed and demonstrably shown.




14.4 

Smile Atelier Whitening – Teeth Whitening



  • Cosmetic whitening gel + LED; no medical diagnosis.
  • Not suitable for customers <16, pregnancy, or active dental issues.
  • Aftercare: 48 hours avoid staining products; brush mild fluoride toothpaste.
  • Deposit = capacity reservation fee → never refund-able.




14.5 

RoffaGrillz – Custom Grills



  • Fully handmade, decorative and remov-able; minor imperfections = normal handwork characteristics.
  • Impression/scan → Design → Fitting → Delivery; approval = acceptance.
  • Always remove while eating, sleeping, working out; clean with mild soap + soft brush.
  • 50% deposit; rest always due; deposit never refund-able.




14.6 

Locked Jewels – Permanent Jewellery



  • Custom-length chain cut and microweld-ed, spark visible → protective eyewear mandatory.
  • Durable, not unbreak-able; pulling/snags/impact = customer’s risk.
  • 14-day warranty only on the weld joint; no warranty on colour, sweat/pH patina, or chemical/pull damage.
  • Re-weld only if the original chain is fully intact; chain lost/damaged → new chain fee applies.
  • Deposit = never refundable (capacity reservation).




14.7 

Sub-Brand Photo/Editorial Services



  • Content captured may be used for marketing unless the Customer explicitly declines in writing before the shoot.
  • Serve Studio retains full IP ownership on all created designs, photos and educational formats.






15. Dispute Resolution



15.1 Dutch law applies; disputes go to civil court NL.
